Locations and transfers

AI Integration Data Residency

Verify where AI integration data is stored, processed and accessed, including diagnostics, support, failover and disaster recovery.

AI data residency cannot be established by pointing to the region of the main database. An integration may also send content to an inference endpoint, embedding service, telemetry collector, support system or recovery location. The useful question is where each relevant data flow is processed, stored and accessible, and whether that flow satisfies the requirements that apply to it.

This guide is for Saudi infrastructure, privacy and procurement teams evaluating a proposed AI architecture. It provides a location-evidence worksheet and a method for resolving unknowns before release. It does not assume that all Saudi data must remain in the Kingdom or that a local cloud endpoint automatically makes an entire service compliant.

Separate residency, access and transfer

Residency describes where data is stored or processed under the defined service arrangement. Access describes who can reach it, from where and under which conditions. A transfer or disclosure assessment considers the actual movement or availability of personal data and the applicable legal rules. These questions overlap, but answering one does not answer the others.

Article 29 of the Personal Data Protection Law sets conditions for transfers or disclosures outside the Kingdom. The Transfer Regulation, version 2.0 of August 2024, provides further rules, including safeguards and specified risk-assessment circumstances. Determine the applicable route for the actual flow with the responsible legal and privacy owners; do not treat a signed generic vendor agreement as automatic permission for every destination.

Other obligations may follow from the entity, sector, data classification or contract. Record which requirements apply and their source. A customer policy requiring a location restriction is a contractual or internal requirement even when it is stricter than the general legal position. Conversely, a vendor's preferred architecture is not evidence that the customer's restriction can be ignored.

For each row, identify the data categories and whether personal information is actually present. Operational metadata may include user identifiers or document references; do not dismiss it as harmless solely because it is called telemetry. A control-plane service may handle different data from an inference service and therefore needs a separate assessment.

The worksheet should name the service and product configuration, not just the supplier. A provider can operate several services with different location commitments. Keep the evidence tied to the purchased offering, selected deployment and relevant contractual version.

Worked example: local inference with an unresolved diagnostic route

Consider an illustrative document-review assistant. Its primary storage and selected inference deployment are configured in an approved Saudi location. The team therefore describes the whole solution as “Saudi hosted”. During review, an engineer discovers that an error collector sends full failed-request payloads to a separate diagnostic service. The location and access terms for that collector have not been assessed.

The correct conclusion is limited: the main storage and inference evidence is established, but the diagnostic flow remains unresolved. The team cannot infer its location from the model endpoint. It should identify the content sent, the recipient, the processing location and available controls, then determine whether to remove the payload, change the destination or complete the required transfer and risk review.

In the proposed design, routine diagnostics use an operation reference, error category and limited technical context. An authorised investigation obtains sensitive source evidence through a controlled route when needed. A test deliberately produces a failed request and inspects the actual outgoing diagnostic payload. This confirms what the deployed integration does rather than what a high-level diagram suggests.

The same method should examine fallback. If the preferred model endpoint is unavailable, a client library or routing service must not silently send the request to a location outside the approved design. The permitted fallback may be another approved deployment, a restricted draft mode or a paused request, depending on the task and requirements.

Ask about remote support and onward disclosure

Data can remain at rest in one country while personnel elsewhere access it. SDAIA's transfer risk-assessment guidance includes remote access and subsequent disclosures among the activities to examine. Treat support access as a concrete data flow, with identified recipients, conditions and evidence, rather than an administrative footnote.

Ask whether support normally sees content, whether access is customer-approved, how it is limited, what is recorded and how subcontractors are involved. Distinguish access to encrypted infrastructure from access to readable customer information. The answer depends on the actual service and key-management arrangement; encryption alone does not prove that the provider or support staff cannot access plaintext.

Record onward recipients and changes to them. The Transfer Regulation addresses subsequent transfers as part of the applicable legal framework. Operationally, the project needs a notification and review route when a supplier changes a support location or subprocessor relevant to the data flow.

Evaluate deployment options against the completed worksheet

Compare a managed service, a private deployment and an on-premise design using the same evidence questions. On-premise inference may still use external embeddings, licensing telemetry or remote maintenance. A managed service may provide strong service-specific location controls, but those need to be verified for the selected features. Neither label answers the whole design.

Separate constraints that are mandatory from preferences that can be traded against cost, capability and operations. For each mandatory restriction, identify the component that enforces it and the test that demonstrates it. For a preference, document the chosen compromise and owner. Cloud versus on-premise AI integration supports the broader responsibility and operating-cost comparison.

Do not make a region choice before verifying the model, service and feature availability you need. Availability can differ across deployments and change over time. The procurement record should capture the actual supported offering and evidence date, with a recheck before production commitment rather than an assumption based on a provider's general presence in Saudi Arabia.

Use three evidence states and a clear release decision

Mark each flow as verified, conditionally acceptable or unresolved. Verified means the required factual and control evidence exists for the agreed configuration. Conditionally acceptable means a named condition must be met, such as disabling content telemetry or obtaining a specified contractual commitment. Unresolved means the team cannot yet establish an essential fact or control.

These are proposed project states, not legal compliance categories. The privacy and security owners determine whether the remaining conditions permit a particular release. Avoid a dashboard that reports “nine checks complete” when one unresolved flow contains the highest-risk data. Severity and decision relevance matter more than the percentage of green cells.

Record the decision, its scope, the evidence version and the change triggers. A vendor assurance for a standard inference endpoint may not apply to a newly enabled agent feature or a separate monitoring product. The design review should follow changes in the actual flow, not only changes in supplier name.

Test location controls through failure and recovery

Use safe sample content to inspect model requests, telemetry, attachment handling and support exports. Verify that prohibited routes are blocked and that errors do not activate an unapproved fallback. Test restoration using the documented recovery configuration; a backup in an approved location does not establish where a restore will run.

Network observations help verify application routing, but they cannot independently prove every provider-internal processing location or support condition. Combine technical evidence with service-specific commitments and appropriate assurance. State the limits of each evidence source rather than claiming that a network trace alone proves global residency.

Security architecture should enforce the approved routes, audit logging should record relevant changes, and PDPL integration compliance should maintain the purpose and processor responsibilities. Deployment planning should preserve these requirements when new environments or recovery paths are introduced.

Prepare the location evidence before procurement closes

A useful supplier request contains the worksheet, data categories, required locations, support-access questions and permitted fallback behaviour. Ask suppliers to identify exceptions explicitly and attach evidence to the exact service configuration. This makes commercial comparison more meaningful than a generic promise of “local hosting”.

FAQ

Your questions, answered.

Does PDPL require every Saudi AI workload to stay inside Saudi Arabia?

Do not make a blanket assumption. Assess the actual personal-data flow against the PDPL transfer provisions and current Transfer Regulation, plus any applicable entity, sector, classification or contractual requirements. Some projects may have stricter location conditions. Record the legal and operational basis for the selected arrangement rather than inferring it from the workload being called Saudi AI.

Is a Saudi model endpoint enough to prove local data residency?

No. Verify storage, pre-processing, embeddings, retrieval, inference, telemetry, support and recovery separately. A locally configured model call does not establish where an error collector stores full payloads or where a backup is restored. Tie evidence to the exact services and settings used by the integration, including fallback routes.

Does overseas remote support matter if the database stays in Saudi Arabia?

It can matter because storage location and access are different questions. Identify what support staff can see, from where, under what approval and with which subcontractors involved. Assess the relevant disclosure or transfer implications with the privacy and legal owners. Encryption at rest alone does not establish that support cannot view readable content.

How should a residency requirement apply to model failover?

Define permitted fallback destinations and behaviours before release. Test that an outage cannot silently route requests to an unapproved service or location. Depending on the requirement and task, the correct fallback may be another approved deployment, reduced functionality or pausing the request. A general availability objective should not silently override an explicit location constraint.

Can network traces prove all of a cloud provider’s processing locations?

They can help verify the application endpoints and routes you observe, but they do not independently establish every internal processing, replication or support arrangement. Combine technical tests with service-specific contractual commitments and appropriate assurance. State what each evidence source proves and what remains dependent on the provider’s documented service controls.

What should procurement request to verify AI data residency?

Request a component-level map naming the data categories, storage and processing locations, replicas, backups, support access, subprocessors and fallback behaviour. Ask for evidence tied to the exact offering and configuration, with explicit exceptions and change-notification terms. Treat unknown high-impact flows as unresolved decisions rather than accepting a general local-hosting statement.
